The right-wing Alternative für Deutschland (AfD) will submit a legal challenge against the incoming German government’s decision to bypass parliament in order to pull off a trillion euro defence scheme. The AfD will file a complaint to the constitutional court next week over the plans to raise new debt through a special fund, which were announced on Wednesday, March 5th by the likely next chancellor Friedrich Merz.

Merz, who leads the centre-right CDU, is in negotiations with the left-wing Social Democrats (SPD) to form a coalition following the elections on February 23rd.

Breaking his promise not to raise more debt for Germany, and bowing to the SPD’s demands, Merz now wants to bypass the newly elected parliament—which only convenes at the end of March—and use the outgoing parliament to push through his proposals.

He is resorting to such an undemocratic measure because the parties that are willing to back him—the CDU/CSU alliance, the SPD, and the Greens—only have the necessary two-thirds majority in the old parliament, not the new one.

The AfD, as well as far-left Die Linke, have said this maneuver is illegitimate.

“The old Bundestag is at best legitimate to act in emergencies, but not to set fundamental course for the future,” the deputy leader of the AfD, Stephan Brandner, said. He added that what the CDU and the SPD are doing is “a conspiracy against democracy” and “reminiscent of a coup.”

The AfD will try to force the Bundestag President, Social Democrat Bärbel Bas, to convene the new parliament as soon as possible. If that fails, they will take the matter to the constitutional court and try to prevent a session of the old Bundestag.

Prominent constitutional law expert Dietrich Murswiek believes the CDU’s trickery amounts to a violation of the rules on what the outgoing parliament is allowed to do.

The old Bundestag is only allowed to take decisions in matters of emergency—decisions that cannot be postponed. Legislation to take on new debt does not fit that category, Murswiek argues, claiming that Merz’s move is a “contempt for the will of the voters.”
